Amióta Al Caponét csak az amerikai adóhatóság tudta börtönbe juttatni, az adóhatósági vizsgálat lehetősége még a legtisztább lelkiismeretű vállalkozónak és vállalatvezetőnek is okoz némi izgalmat. Pedig az idegesség ilyenkor rossz tanácsadó, a tisztesség azonban kifizetődő. Az adóhatósági eljárásban ugyanis az adózó nem védtelen, hiszen a hatóság kezét eljárási szabályok kötik, és számtalan jogorvoslati lehetőség is létezik.

(I.) Az ellenőrzés megkezdése…

Az adóhatóság adóellenőrzést kizárólag megbízólevél alapján folytathat le. A megbízólevél egyben korlátozza is az ellenőrzés folyamatát. A megbízólevél ugyanis azt is tartalmazza, hogy az adóhatóság mely adómegállapítási időszakot, és mely adónemeket vonja ellenőrzés alá. Ez a dokumentum egyébként fel is hatalmazza a név szerint megjelölt adóellenőröket az eljárásra. Létezik általános megbízólevél is, amelyen nincs feltüntetve a vizsgálat alá vont adózó, sem pedig az ellenőrzéssel érintett időszak: ezt piacokon, utcai árusok ellenőrzésekor alkalmazzák, amikor adóhatóság előre meg nem nevezett személyeket von ellenőrzés alá.

Az adóellenőrzésről általában – telefonon vagy írásban – előre értesítik az adózót. Bizonyos esetekben az adóhatóság mellőzheti is az előzetes értesítést: ilyenkor a megbízólevelet az eljárás megkezdésekor adják át.

Az ellenőrzés kezdetének elhalasztását – legfeljebb 60 nappal –, vagy az ellenőrzés szünetelését akadályoztatásra hivatkozással csak magánszemélyek kérhetik. Érdemes azonban társaságok esetében is – amennyiben felkészülési időre van szükség –, a revizorokkal egy olyan kezdési időpontban megállapodni, amikorra a szükséges dokumentumokat elő tudjuk készíteni. Az iratok rendezésre, pótlására egyébként az ellenőrzés során lehet időt kérni, igaz, ezzel a mulasztási bírságot kockáztatjuk.

Az ellenőrzés megkezdéséig, vagyis a megbízólevél átadásáig, az ellenőrzéssel még le nem zárt időszakokra az adózó korlátozás nélkül végezhet önellenőrzést. Az adóznak továbbá joga van befejezni az ellenőrzés megkezdésekor már folyamatban lévő önellenőrzéseit. A cégeknek tehát ez év végéig van némi mozgásterük egy gyors korrekció elvégzésére, 2011. január 1. után ugyanis az adóhatóság már csak azt az önellenőrzést fogadja el, amelyet az ellenőrzés megkezdéséig benyújtottak.

Az eljárás, az előzetes értesítés vagy a megbízólevél átvételének megtagadása esetén is, a törvény alapján elkezdődik, ezért ezen cselekedetek inkább csak a kapcsolat elmérgesítését segítik elő, mintsem hogy hatékony jogi eszközöknek bizonyulnának. A cserkészköszöntés (Légy résen!) tehát az adóellenőrzésre is érvényes. Az angol eredeti (Be prepared!) fordítása (Készüljön fel!) egyébként ebben az esetben még helytállóbb.

Az adóellenőrzés bejelentésekor tehát a cégvezető haladéktalanul forduljon a vállalkozás könyvelőjéhez, illetve az adózási kérdésekben is járatos ügyvédjéhez, azért, hogy ezen szakértők az első pillanattól fogva érvényesíthessék az adózó jogait az eljárás során.
